1. Agreement to These Terms
These Terms of Service govern access to and use of OSBeats, including marketplace, profile, upload, promotion, membership, messaging, licensing, and related features. By using OSBeats, you agree to follow these Terms and all policies incorporated into them.
2. Accounts and Platform Access
You are responsible for accurate account information, maintaining the security of your credentials, and activity performed through your account. OSBeats may restrict, suspend, or deactivate accounts that violate platform rules or create security, fraud, legal, payment-processing, or marketplace risk.
3. Creator Content and Ownership
Creators retain ownership of content they lawfully upload. By uploading content, you grant OSBeats the limited rights needed to host, display, stream, promote, index, moderate, and make the content available through the platform. You must own or have all permissions necessary for any music, samples, vocals, artwork, images, text, logos, or other content you submit.
4. Strictly Prohibited Content and Services
OSBeats does not permit content, services, listings, payments, or monetization involving prohibited material. This includes:
- Pornography, sexually explicit content, nudity presented for sexual gratification, adult live-chat content, sexual services, escort services, prostitution, fetish services, or other adult-oriented services.
- Sexually explicit or adult content generated with artificial intelligence.
- Content that sexually exploits or endangers minors, or any unlawful sexual content.
- Copyright-infringing, pirated, stolen, or otherwise unauthorized music, samples, artwork, images, or other intellectual property.
- Content that promotes or celebrates unlawful violence, violent extremist organizations, terrorism, or hate-based violence.
- Content that promotes hatred or dehumanizing abuse targeting people based on protected characteristics.
- Illegal goods, services, scams, fraud, or other unlawful activity.
OSBeats is a music marketplace. Adult entertainment, adult creator content, and sexual-content monetization are not permitted anywhere on the platform.
5. Marketplace Transactions
Beat licenses, direct purchases, bundles, memberships, and paid promotions may have different terms and prices. Buyers are responsible for reviewing the applicable license before purchase. Creators are responsible for accurately describing what rights are being offered. OSBeats may block or reverse access to platform features where a transaction or listing violates these Terms or payment-provider requirements.
6. Payment and Money-Transmission Restrictions
OSBeats payments must relate to legitimate platform products or services. Users may not use OSBeats for peer-to-peer money transmission, cash-equivalent transfers, disguised payments, payment laundering, tipping unrelated to permitted content, or attempts to move money outside legitimate marketplace transactions.
7. Reporting, Monitoring, and Enforcement
OSBeats provides reporting tools that allow users, rights holders, and other affected parties to report content or accounts that may violate these Terms or platform policies. Reports may be reviewed by authorized moderators and Admin. OSBeats may hide or remove content, restrict monetization, suspend accounts, terminate access, preserve audit records, and take other appropriate action.
8. Repeat Violators
OSBeats may suspend or permanently terminate users who repeatedly violate copyright rules, the Acceptable Use Policy, the Content Policy, or other platform requirements. Serious violations may result in immediate removal or termination without a prior warning.
9. Availability
OSBeats may change, suspend, or discontinue features as the service develops. We do not guarantee uninterrupted availability.
10. Limitation of Liability
To the extent allowed by law, OSBeats is not responsible for indirect or consequential losses arising from use of the service, creator-to-buyer disputes, or third-party services.
11. Changes
These Terms may be updated as OSBeats evolves, including when required by payment processors, financial partners, law, or platform-safety requirements. Material changes may be communicated through the website or account notices.
